In his forthcoming book WELCOME THE WRETCHED: In Defense of the “Criminal Alien”, law professor and immigration lawyer César Cuauhtémoc García Hernández makes a powerful case for divorcing immigration law from criminal law—including abolishing so-called immigration crimes (such as crossing and re-crossing the border “illegally”), and allowing migrants who have been accused or convicted of crimes to remain in the U.S. as residents or citizens.
García Hernández isn’t basing these proposals on a fantasy. What he describes was U.S. policy until the late 20 the century. For decades, people from other nations who crossed the border into the United States were not considered criminals. In fact, migrants residing in the United States who committed crimes were not only not deported; they were welcome to live here.
